The individuals and groups named are and were as stated in this information. This is posted as a clear warning to all that the HOC-AJ of Tennessee with a presence in Madison, Fla. are not in any way associated with the Church Archbishop Aftimios Ofiesh of Blessed Memory was appointed to head in 1927.
Their claim to be THEOCACNA under another name is false.
Their claim to our Church history is a false claim.
Their claim to our Name and logo, our legal service mark and property of THEOCACNA is a criminal act - Identity theft, fraud, Service mark infrindement and dilution.
Their posting of fraudulent documents in no way makes them THEOCACNA.
Their claim to THEOCACNA is based on a bogus form showing the appointment of one of their clergy as Metropolitan of THEOCACNA - this document is posted on their website document page (holyorthodoxchurch.com) dated about July 2008 and a Dec 2007 Florida corporation under our name.
Before we proceed we will mention Trademark law.
The law says (15 USC 1065) that once you own a service mark for 5 years it is yours. The original corporate Church has had the name since 1927 under common law. In 2000 the name & logo were registered as the Service Mark of the American Church so by 2005 we, the original corporation, owned our name & logo, our recognized Service Mark.
Any group who lies and claims to be who or what they are not as this group does show they are unchristian and anything but clergy. When they claim a service or trademark and as this group did - incorporate in one state under another Churches name and use their service mark on their website then claim the Corporate President and others "tried to steal their church corporation" they act in a criminal manner as well as defaming others. This group claimed first a 1937 corporation in NY, the a 1932 corporation they claim still exists. Also that it was by special act. The Secretary of States office in NY could find no such corporation when we asked.
The brief history of the HOC-AJ is a false claim for status and recognition.
Archbishop Aftimios Ofiesh headed the Original 1927 Chartered Church and the 1928 Church Corporation. The constitution of this Church required the Presiding Bishop, at that time Abp. Aftimios Ofiesh, to head the Corporation. He did not head a 1931, 1932 or 1937 New York Corporation. If such a corporation exists our Presiding bishop would head that Corporation also.
They claim the following;
This group claims that their clergy who left this Church renounced their consecrations and were incardinated into the Antiochian Church as priests.
They were not associated with THEOCACNA in any way after they entered the Antiochian Church. They are still not associated with this Church.
They claim Bishop Ignatius ordained Alexander Tyler Turner but with no mandate or authority from this Church since Ignatius left THEOCACNA and all his authority to marry and head a protestant Church in 1934. This makes any acts independent and old catholic since Orthodoxy does not recognize such acts.
They claim not all members of the Society of Clerks Secular of Saint Basil entered the Antiochian Church therefore some members remained members of THEOCACNA or left and became independent of Orthodoxy.
We believe that any independents who must lie about who they are neither christian nor clergy.
An unincorporated entity
From online documents it would appear that Forbes incorporated in Tennessee in 1982 the Church name "Holy Orthodox Church - American Jurisdiction". In 1985 the corporate status, and name, were no longer incorporated.
Over 20 years later this unincorporated group continued to use this name and in 2007 decided to claim to be The Holy Eastern Orthodox Catholic and Apostolic Church in North America. It would appear to be a planned act since in July 2007 Carl Bartholomew claims to have been elected to Metropolitan of The Holy Eastern Orthodox Catholic and Apostolic Church in North America, not the HOC-AJ and then to incorporate in Fla. in Dec 2007 using the name of The Holy Eastern Orthodox Catholic and Apostolic Church in North America, the Church headed by Abp. Ofiesh and then to claim to be both the HOC-AJ and THEOCACNA.
Their new primate appears to be a former Roman Catholic Priest and not Orthodox based on his claim of lines of Apostolic Succession being in the Catholic manner of Episcopi Vagantes. In Orthodoxy the term Episcopi Vagantes is not accepted or recognized.
They have decided to claim the history of another Church that was organized in 1927 by Archbishop Aftimios. They also claim to have been Chartered in 1932, previously claimed 1937, in New York but that charter is under another name and no information has been located.
They claim to have 82 continuous years of service to both the Western and Eastern Rite Orthodox Reorganized in 1974 by Archbishop Francis W. Forbes as Holy Orthodox Church-American Jurisdiction.
The could only have 81 years servce if they were The Holy Eastern Orthodox Catholic and Apostolic Church in North America, but they are not. They are claiming our history now, they have used our Logo and name, our legal service mark, and Carl Bartholomew claims to be the metropolitan of The Holy Eastern Orthodox Catholic and Apostolic Church in North America but he is in no way associated with THEOCACNA.
In approx. Dec. 2007 this Bp Alexander incorporated in Florida using our name and he posted our logo on his domain thus infringing and diluting our service mark. Such acts are not those of honest clergy. To take an old established corporate name and history and then threaten the Corporate President and Archbishop with legal action if he contacts this Bp Alexander (Carl D. Bartholomew) and claim he, the corporate President of over 11 years, committed a criminal act regarding the Church documents are the acts of someone who lies, steals church property, i.e. Service Mark which is the name and logo of the Church corporation. The President asked him to please proceed with legal action and proceeded to file criminal complaints with state and federal law enforcement.
Based on the claims of legal action against us if we sent him any documents (claims of our identity) by Mr Bartholomew and his continued Bried History claiming to be the Church of Abp Ofiesh (American Orthodox Church) we believe him to be a liar who intends to deceive, mislead and infringe our legally owned property and our history.
The Church name and logo are the legal property of The Holy Eastern Orthodox Catholic and Apostolic Church in North America under common law since the name and logo have been used since 1927 or for over 80 years, and since the name & logo have been the Registered service mark of the Church since 2000 (until 2007) it is the legal property of The Holy Eastern Orthodox Catholic and Apostolic Church in North America and not up for grabs by anyone who feels they want to be THEOCACNA.
It should be noted that since Abp. Forbes retired his church has been taken over by a former Roman Catholic priest who writes fairy tales to make himself appear to be Orthodox. He also wants to appear to be important so he has incorporated in Florida under the name of the original 1927 Church: "The Holy Eastern Orthodox Catholic and Apostolic Church in North America". He has made many false claims such as being the primate of the original Church, which he is not and cannot be since he has never been associated with The Holy Eastern Orthodox Catholic and Apostolic Church in North America.
This Abp. Alexander, who claims to be the Primate of both the Holy Orthodox Church - AJ and The Holy Eastern Orthodox Catholic and Apostolic Church in America (now he has dropped "North") does not even appear to be Orthodox and is only head of his little Florida Corporation whose name he has stolen from The Holy Eastern Orthodox Catholic and Apostolic Church in North America.

This Carl Bartholomew, who claims to be the presiding Bishop of "The Holy Eastern Orthodox Catholic and Apostolic Church in (North) America" and the Holy Orthodox Church - American Jurisdiction is making false claims
